Fascist Italy and Nazi Germany bombed, invaded and annexed countries and territories as a prelude to their quest for World Empire.  Israel’s drive for regional dominance has followed in their footsteps, imitating their style: Indiscriminate aerial bombings of civilian and military facilities, a savage blitzkrieg led by armored vehicles, disdain and repudiation of all criticism from international agencies was accompanied by an open, military buildup for a new and bigger war against Iran.  Like the Nazi leadership, who played on the ‘Bolshevik threat’, the Israeli high command has set in motion a vast world-wide propaganda campaign led by its world Zionist network, raising the specter of ‘Islamic terror’ to justify its preparations for a military assault on seventy-four million Iranians.  Just as Nazi Germany interpreted the passivity, sympathy and impotence of the West when confronted by ‘facts on the ground’ as license for aggression, the Israeli military machine receives a powerful impetus for new wars by the Western governments’ inaction and flaccid response to its invasion of Lebanon, the bombing of Syria and now its Nazi style blitz and conquest of Gaza.  For the Israeli high command, the impotence and complicity of the Western states, marks the way to bigger and bloodier wars to establish Israel’s supremacy and dominance of the Middle East, from the Red Sea to the Persian Gulf.

Gaza Blitz:  Dress Rehearsal for an Assault on Iran

Israel’s military victory in Gaza is a dress rehearsal for a full-scale military assault on Iran.  In the course of their Gaza extermination campaign, Israeli political and military strategists gained a great deal of vital information about: (1) the levels of complicity and impotence of European, North American and Arab states;  (2) the high degree and depth of material and political support obtainable from the United States government in pulverizing adversaries; (3) the high degree of internal support among the Jewish electorate for even the most brutal killing fields; (4) the massive unquestioning backing of an offensive war from all the biggest and most politically influential and wealthiest Jewish-Zionist organizations in the US and Western Europe; (5) the weakness and ineffectiveness of the United Nations and the incapacity of the entire range of humanitarian organizations to limit Israel’s extermination campaign directed at destroying the very existence of an entire people; (6) the unconditional backing of the entire mass media and news agencies in the US and most of the mass media in Europe and the rest of the world; (7) the willingness of the liberal critics to equally blame the victims of extermination and the exterminators for the ‘violence’, thus neutralizing any effective consequential condemnation of the Israeli state; and (8) the adaptation of practically all the journalists, writers, academics and politicians to the entire euphemistic vocabulary of the Israeli propaganda office.

For example, sustained total war is called an ‘incursion’.  Ten thousand aerial assaults by hundreds of Israeli helicopters and fighter-bombers are equated with sporadic harmless homemade rocket attacks as ‘violence’.  Israeli targeting of thousands of civilian homes, hospitals and basic infrastructure are labeled ‘terrorist’ targets.  Resistance fighters are labeled ‘Hamas terrorists’.  The bombing of the Red Cross, the United Nations relief facilities, hospitals, mosques are called ‘mistakes’ or justified as ‘launching sites for Hamas terrorists.

Israeli political leaders have drawn the lesson from their dirty little ‘war’ that they can totally destroy a nation, decimate a society and murder and maim 7000 civilians with impunity.  Israeli leaders learned they can carry out an offensive genocidal war without suffering breaks in diplomatic relations (except Mauritania, Qatar, Bolivia and Venezuela).  The Israelis have successfully tested the loyalty and submissiveness of the major Arab regimes in the region and secured cooperation and acquiescence from Egypt, the ‘Palestinian Authority’, Jordan and Saudi Arabia.  Israeli civilian-military leaders calculate that with this high degree of governmental complicity, combined with support from all the major Zionist leaders and mass media moguls, they can dismiss even large-scale street protests, repeated calls for boycotts and United Nations denunciations.  Israeli leaders know that the criticism of major religious leaders and the growing number of Jewish dissidents, critical intellectuals and activists will have no consequential impact on Western governments nor lessen the fervor and loyalty of the major Jewish organizations.

Obama to let CIA use controversial renditions

WASHINGTON — The CIA’s secret prisons and Guantánamo Bay detention center are being shuttered. Harsh interrogation techniques are off-limits.

But, under executive orders issued by President Barack Obama last week, the CIA still has authority to carry out “renditions,” the secret abductions and transfers of prisoners to countries that cooperate with the U.S.

Current and former U.S. intelligence officials said that the rendition program may be poised to play an expanded role going forward because it is the main remaining mechanism — aside from Predator missile strikes — for taking suspected terrorists off the street.

“Obviously you need to preserve some tools. You still have to go after the bad guys,” said an Obama administration official, speaking on condition of anonymity when discussing the legal reasoning. “The legal advisers working on this looked at rendition. It is controversial in some circles. … But if done within certain parameters, it is an acceptable practice.”

The decision to preserve the program didn’t draw major protests, even among some human rights groups.

“Under limited circumstances, there is a legitimate place” for renditions, said Tom Malinowski, the Washington advocacy director for Human Rights Watch.

But Malinowski said he has urged the Obama administration to require that prisoners be transferred to other countries only when there is a guarantee they will get a public hearing in an official court. “Producing a prisoner before a real court is a key safeguard against torture, abuse and disappearance,” Malinowski said.

Human Rights Activists Call to Try Bush

BERLIN, Feb 2 (IPS) – Now that former U.S. president George W. Bush is an ordinary citizen again, many legal and human rights activists in Europe are demanding that he and high-ranking members of his government be brought before justice for crimes against humanity committed in the so-called war on terror.

“Judicial clarification of the crimes against international law the former U.S. government committed is one of the most delicate issues that the new U.S. president Barack Obama will have to deal with,” Wolfgang Kaleck, general secretary of the European Centre for Human and Constitutional Rights told IPS.

U.S. justice will have to “deal with the turpitudes committed by the Bush government,” says Kaleck, who has already tried unsuccessfully to sue the former U.S. authorities in European courts. “And, furthermore, the U.S. government will have to pay compensation to the innocent people who were victims of these crimes.”

Kaleck and other legal experts consider Bush and his highest-ranking officials responsible for crimes against humanity, such as torture.

Many agree that the evidence against the U.S. government is overwhelming. U.S. officials have admitted some crimes such as waterboarding, where a victim is tied up and water is poured into the air passages. Also, human rights activists have gathered testimonies by innocent victims of torture, especially some prisoners at the Guantanamo Bay detention camp.

In an interview with the German public television network ZDF, Austrian human rights lawyer Manfred Nowak, UN special rapporteur on torture, said that numerous cases of torture ordered by U.S. officials and perpetrated by U.S. authorities are well documented.

“We possess all the evidence which proves that the torture methods used in interrogation by the U.S. government were explicitly ordered by former U.S. defence minister Donald Rumsfeld,” Nowak told ZDF. “Obviously, these orders were given with the highest U.S. authorities’ knowledge.”

“George W. Bush is without doubt responsible for crimes such as torture,” says Dietmar Herz, professor of political science at the university of Erfurt, 235 km southwest of Berlin.

“According to the U.S. constitution, the U.S. president is responsible for all actions carried out by the executive,” Herz told IPS. “Therefore, George W. Bush is responsible for the torture methods used by U.S. authorities, such as waterboarding.”

International justice against crimes against humanity began in 1945, with the Nuremberg trials against Nazi criminals, says Kaleck. Leading prosecutor Robert Jackson said at the opening of the trials in October 1945 that “we are able to do away with…tyranny and violence and aggression by those in power against the rights of (the) people…only when we make all men answerable to the law.”

But since then this promise has been fulfilled only in exceptional cases, Kaleck said.

“Crimes against humanity have been repeatedly committed ever since, but very few people have been brought before international courts for these crimes,” he said, adding that this impunity is particularly obvious for leaders of the Allied countries (such as the U.S., France and Britain), who had organised the Nuremberg trials.

Nobody was ever judged for crimes against humanity committed in Algeria by France, in Vietnam and Latin America by the U.S., in Afghanistan by the Soviet Union and in Chechnya by Russia.

Only in the 1990s, after the Yugoslav wars of secession, the Rwanda genocide, and civil wars in countries such as Liberia and Sierra Leone were state criminals captured, judged and convicted.

“The creation of the International Criminal Court (ICC) in 2002 in The Hague in the Netherlands marks a turning point in the prosecution of state officials accused of crimes such as genocide, crimes against humanity or of war,” Kaleck added.

But prosecution for crimes of war or for crimes against humanity continues to be highly selective. So far, only perpetrators from weak or failed states from south-eastern Europe, or from the south, especially Africa, have been brought to court. In a case such as that of former Chilean dictator Augusto Pinochet, Britain acted as an accomplice to protect him.

Over the last couple of years, human rights activists and some national courts in Europe have been fighting these arbitrary ways. They are appealing for, and in some cases even applying, a universal jurisdiction of national courts.

The Spanish judiciary has opened cases against Latin American dictators such as Guatemalan general Efraín Ríos Montt, who ruled the Central American country between 1982 and 1983, and Argentinean military officers involved in kidnapping and killing civilians.

Chomsky: Neither The US Nor Israel Is A “Genuine Party To Peace.”

Barack Obama is recognized to be a person of acute intelligence, a legal scholar, careful with his choice of words. He deserves to be taken seriously – both what he says, and what he omits. Particularly significant is his first substantive statement on foreign affairs, on January 22, at the State Department, when introducing George Mitchell to serve as his special envoy for Middle East peace.

Mitchell is to focus his attention on the Israel-Palestine problem, in the wake of the recent US-Israeli invasion of Gaza. During the murderous assault, Obama remained silent apart from a few platitudes, because, he said, there is only one president – a fact that did not silence him on many other issues. His campaign did, however, repeat his statement that “if missiles were falling where my two daughters sleep, I would do everything in order to stop that.” He was referring to Israeli children, not the hundreds of Palestinian children being butchered by US arms, about whom he could not speak, because there was only one president.

On January 22, however, the one president was Barack Obama, so he could speak freely about these matters – avoiding, however, the attack on Gaza, which had, conveniently, been called off just before the inauguration.

Obama’s talk emphasized his commitment to a peaceful settlement. He left its contours vague, apart from one specific proposal: “the Arab peace initiative,” Obama said, “contains constructive elements that could help advance these efforts. Now is the time for Arab states to act on the initiative’s promise by supporting the Palestinian government under President Abbas and Prime Minister Fayyad, taking steps towards normalizing relations with Israel, and by standing up to extremism that threatens us all.”

Obama is not directly falsifying the Arab League proposal, but the carefully framed deceit is instructive.

The Arab League peace proposal does indeed call for normalization of relations with Israel – in the context – repeat, in the context of a two-state settlement in terms of the longstanding international consensus, which the US and Israel have blocked for over 30 years, in international isolation, and still do. The core of the Arab League proposal, as Obama and his Mideast advisers know very well, is its call for a peaceful political settlement in these terms, which are well-known, and recognized to be the only basis for the peaceful settlement to which Obama professes to be committed. The omission of that crucial fact can hardly be accidental, and signals clearly that Obama envisions no departure from US rejectionism. His call for the Arab states to act on a corollary to their proposal, while the US ignores even the existence of its central content, which is the precondition for the corollary, surpasses cynicism.

The most significant acts to undermine a peaceful settlement are the daily US-backed actions in the occupied territories, all recognized to be criminal: taking over valuable land and resources and constructing what the leading architect of the plan, Ariel Sharon, called “Bantustans” for Palestinians – an unfair comparison because the Bantustans were far more viable than the fragments left to Palestinians under Sharon’s conception, now being realized. But the US and Israel even continue to oppose a political settlement in words, most recently in December 2008, when the US and Israel (and a few Pacific islands) voted against a UN resolution supporting “the right of the Palestinian people to self-determination” (passed 173 to 5, US-Israel opposed, with evasive pretexts).

Obama had not one word to say about the settlement and infrastructure developments in the West Bank, and the complex measures to control Palestinian existence, designed to undermine the prospects for a peaceful two-state settlement. His silence is a grim refutation of his oratorical flourishes about how “I will sustain an active commitment to seek two states living side by side in peace and security.”

Also unmentioned is Israel’s use of US arms in Gaza, in violation not only of international but also US law. Or Washington’s shipment of new arms to Israel right at the peak of the US-Israeli attack, surely not unknown to Obama’s Middle East advisers.

Obama was firm, however, that smuggling of arms to Gaza must be stopped. He endorses the agreement of Condoleeza Rice and Israeli foreign minister Tzipi Livni that the Egyptian-Gaza border must be closed – a remarkable exercise of imperial arrogance, as the Financial Times observed: “as they stood in Washington congratulating each other, both officials seemed oblivious to the fact that they were making a deal about an illegal trade on someone else’s border – Egypt in this case. The next day, an Egyptian official described the memorandum as `fictional’.” Egypt’s objections were ignored.

Returning to Obama’s reference to the “constructive” Arab League proposal, as the wording indicates, Obama persists in restricting support to the defeated party in the January 2006 election, the only free election in the Arab world, to which the US and Israel reacted, instantly and overtly, by severely punishing Palestinians for opposing the will of the masters. A minor technicality is that Abbas’s term ran out on January 9, and that Fayyad was appointed without confirmation by the Palestinian parliament (many of them kidnapped and in Israeli prisons). Ha’aretz describes Fayyad as “a strange bird in Palestinian politics. On the one hand, he is the Palestinian politician most esteemed by Israel and the West. However, on the other hand, he has no electoral power whatsoever in Gaza or the West Bank.” The report also notes Fayyad’s “close relationship with the Israeli establishment,” notably his friendship with Sharon’s extremist adviser Dov Weiglass. Though lacking popular support, he is regarded as competent and honest, not the norm in the US-backed political sectors.

Obama’s insistence that only Abbas and Fayyad exist conforms to the consistent Western contempt for democracy unless it is under control.

Obama provided the usual reasons for ignoring the elected government led by Hamas. “To be a genuine party to peace,” Obama declared, “the quartet [US, EU, Russia, UN] has made it clear that Hamas must meet clear conditions: recognize Israel’s right to exist; renounce violence; and abide by past agreements.” Unmentioned, also as usual, is the inconvenient fact that the US and Israel firmly reject all three conditions. In international isolation, they bar a two-state settlement including a Palestinian state; they of course do not renounce violence; and they reject the quartet’s central proposal, the “road map.” Israel formally accepted it, but with 14 reservations that effectively eliminate its contents (tacitly backed by the US). It is the great merit of Jimmy Carter’s Palestine: Peace not Apartheid, to have brought these facts to public attention for the first time – and in the mainstream, the only time.

It follows, by elementary reasoning, that neither the US nor Israel is a “genuine party to peace.” But that cannot be. It is not even a phrase in the English language.

It is perhaps unfair to criticize Obama for this further exercise of cynicism, because it is close to universal, unlike his scrupulous evisceration of the core component of the Arab League proposal, which is his own novel contribution.

Also near universal are the standard references to Hamas: a terrorist organization, dedicated to the destruction of Israel (or maybe all Jews). Omitted are the inconvenient facts that the US-Israel are not only dedicated to the destruction of any viable Palestinian state, but are steadily implementing those policies. Or that unlike the two rejectionist states, Hamas has called for a two-state settlement in terms of the international consensus: publicly, repeatedly, explicitly.

Obama began his remarks by saying: “Let me be clear: America is committed to Israel’s security. And we will always support Israel’s right to defend itself against legitimate threats.”

There was nothing about the right of Palestinians to defend themselves against far more extreme threats, such as those occurring daily, with US support, in the occupied territories. But that again is the norm.

Also normal is the enunciation of the principle that Israel has the right to defend itself. That is correct, but vacuous: so does everyone. But in the context the cliche is worse than vacuous: it is more cynical deceit.

The issue is not whether Israel has the right to defend itself, like everyone else, but whether it has the right to do so by force. No one, including Obama, believes that states enjoy a general right to defend themselves by force: it is first necessary to demonstrate that there are no peaceful alternatives that can be tried. In this case, there surely are.

A narrow alternative would be for Israel to abide by a cease-fire, for example, the cease-fire proposed by Hamas political leader Khaled Mishal a few days before Israel launched its attack on December 27. Mishal called for restoring the 2005 agreement. That agreement called for an end to violence and uninterrupted opening of the borders, along with an Israeli guarantee that goods and people could move freely between the two parts of occupied Palestine, the West Bank and the Gaza Strip. The agreement was rejected by the US and Israel a few months later, after the free election of January 2006 turned out “the wrong way.” There are many other highly relevant cases.

The broader and more significant alternative would be for the US and Israel to abandon their extreme rejectionism, and join the rest of the world – including the Arab states and Hamas – in supporting a two-state settlement in accord with the international consensus. It should be noted that in the past 30 years there has been one departure from US-Israeli rejectionism: the negotiations at Taba in January 2001, which appeared to be close to a peaceful resolution when Israel prematurely called them off. It would not, then, be outlandish for Obama to agree to join the world, even within the framework of US policy, if he were interested in doing so.

In short, Obama’s forceful reiteration of Israel’s right to defend itself is another exercise of cynical deceit – though, it must be admitted, not unique to him, but virtually universal.

The deceit is particularly striking in this case because the occasion was the appointment of Mitchell as special envoy. Mitchell’s primary achievement was his leading role in the peaceful settlement in northern Ireland. It called for an end to IRA terror and British violence. Implicit is the recognition that while Britain had the right to defend itself from terror, it had no right to do so by force, because there was a peaceful alternative: recognition of the legitimate grievances of the Irish Catholic community that were the roots of IRA terror. When Britain adopted that sensible course, the terror ended. The implications for Mitchell’s mission with regard to Israel-Palestine are so obvious that they need not be spelled out. And omission of them is, again, a striking indication of the commitment of the Obama administration to traditional US rejectionism and opposition to peace, except on its extremist terms.

Obama also praised Jordan for its “constructive role in training Palestinian security forces and nurturing its relations with Israel” – which contrasts strikingly with US-Israeli refusal to deal with the freely elected government of Palestine, while savagely punishing Palestinians for electing it with pretexts which, as noted, do not withstand a moment’s scrutiny. It is true that Jordan joined the US in arming and training Palestinian security forces, so that they could violently suppress any manifestation of support for the miserable victims of US-Israeli assault in Gaza, also arresting supporters of Hamas and the prominent journalist Khaled Amayreh, while organizing their own demonstrations in support of Abbas and Fatah, in which most participants “were civil servants and school children who were instructed by the PA to attend the rally,” according to the Jerusalem Post. Our kind of democracy.

Obama made one further substantive comment: “As part of a lasting cease-fire, Gaza’s border crossings should be open to allow the flow of aid and commerce, with an appropriate monitoring regime…” He did not, of course, mention that the US-Israel had rejected much the same agreement after the January 2006 election, and that Israel had never observed similar subsequent agreements on borders.

Also missing is any reaction to Israel’s announcement that it rejected the cease-fire agreement, so that the prospects for it to be “lasting” are not auspicious. As reported at once in the press, “Israeli Cabinet Minister Binyamin Ben-Eliezer, who takes part in security deliberations, told Army Radio on Thursday that Israel wouldn’t let border crossings with Gaza reopen without a deal to free [Gilad] Schalit” (AP, Jan 22); ‘Israel to keep Gaza crossings closed…An official said the government planned to use the issue to bargain for the release of Gilad Shalit, the Israeli soldier held by the Islamist group since 2006 (Financial Times, Jan. 23); “Earlier this week, Israeli Foreign Minister Tzipi Livni said that progress on Corporal Shalit’s release would be a precondition to opening up the border crossings that have been mostly closed since Hamas wrested control of Gaza from the West Bank-based Palestinian Authority in 2007” (Christian Science Monitor, Jan. 23); “an Israeli official said there would be tough conditions for any lifting of the blockade, which he linked with the release of Gilad Shalit” (FT, Jan. 23); among many others.

Shalit’s capture is a prominent issue in the West, another indication of Hamas’s criminality. Whatever one thinks about it, it is uncontroversial that capture of a soldier of an attacking army is far less of a crime than kidnapping of civilians, exactly what Israeli forces did the day before the capture of Shalit, invading Gaza city and kidnapping two brothers, then spiriting them across the border where they disappeared into Israel’s prison complex. Unlike the much lesser case of Shalit, that crime was virtually unreported and has been forgotten, along with Israel’s regular practice for decades of kidnapping civilians in Lebanon and on the high seas and dispatching them to Israeli prisons, often held for many years as hostages. But the capture of Shalit bars a cease-fire.

Obama’s State Department talk about the Middle East continued with “the deteriorating situation in Afghanistan and Pakistan… the central front in our enduring struggle against terrorism and extremism.” A few hours later, US planes attacked a remote village in Afghanistan, intending to kill a Taliban commander. “Village elders, though, told provincial officials there were no Taliban in the area, which they described as a hamlet populated mainly by shepherds. Women and children were among the 22 dead, they said, according to Hamididan Abdul Rahmzai, the head of the provincial council” (LA Times, Jan. 24).

Afghan president Karzai’s first message to Obama after he was elected in November was a plea to end the bombing of Afghan civilians, reiterated a few hours before Obama was sworn in. This was considered as significant as Karzai’s call for a timetable for departure of US and other foreign forces. The rich and powerful have their “responsibilities.” Among them, the New York Times reported, is to “provide security” in southern Afghanistan, where “the insurgency is homegrown and self-sustaining.” All familiar. From Pravda in the 1980s, for example.

Holbrooke: Insensitive Choice for a Sensitive Region

Obama’s choice for special envoy to Afghanistan and Pakistan, arguably the most critical area of U.S. foreign policy, is a man with perhaps the most sordid history of any of the largely disappointing set of foreign policy and national security appointments.

Richard Holbrooke got his start in the Foreign Service during the 1960s, in the notorious pacification programs in the Mekong Delta of South Vietnam. This ambitious joint civilian-military effort not only included horrific human rights abuses but also proved to be a notorious failure in curbing the insurgency against the U.S.-backed regime in Saigon. This was an inauspicious start in the career of someone Obama hopes to help curb the insurgency against the U.S.-backed government in Afghanistan.

In Asia

In the late 1970s, Holbrooke served as assistant secretary of State for East Asian and Pacific Affairs. In this position, he played a major role in formulating the Carter administration’s support for Indonesia’s occupation of East Timor and the bloody counterinsurgency campaign responsible for up to a quarter-million civilian deaths. Having successfully pushed for a dramatic increase in U.S. military aid to the Suharto dictatorship, he then engaged in a cover-up of the Indonesian atrocities. He testified before Congress in 1979 that the mass starvation wasn’t the fault of the scorched-earth campaign by Indonesian forces in the island nation’s richest agricultural areas, but simply a legacy of Portuguese colonial neglect. Later, in reference to his friend Paul Wolfowitz, then the U.S. ambassador to Indonesia, Holbrooke described how “Paul and I have been in frequent touch to make sure that we keep [East Timor] out of the presidential campaign, where it would do no good to American or Indonesian interests.”

In a particularly notorious episode while heading the State Department’s East Asia division, Holbrooke convinced Carter to release South Korean troops under U.S. command in order to suppress a pro-democracy uprising in the city of Kwangju. Holbrooke was among the Carter administration officials who reportedly gave the OK to General Chun Doo-hwan, who had recently seized control of the South Korean government in a military coup, to wipe out the pro-democracy rebels. Hundreds were killed.

He also convinced President Jimmy Carter to continue its military and economic support for the Marcos dictatorship in the Philippines.

At the UN

Holbrooke, as the U.S. ambassador to the United Nations in the late 1990s, criticized the UN for taking leadership in conflict resolution efforts involving U.S. allies, particularly in the area of human rights. For example, in October 2000 he insisted that a UN Security Council resolution criticizing the excessive use of force by Israeli occupation forces against Palestinian demonstrators revealed an unacceptable bias that put the UN “out of the running” in terms of any contributions to the peace process.

As special representative to Cyprus in 1997, Holbrooke unsuccessfully pushed the European Union to admit Turkey, despite its imprisonment of journalists, its ongoing use of the death penalty, its widespread killing of civilians in the course of its bloody counter-insurgency war in its Kurdish region, and other human rights abuses.

In the Former Yugoslavia

Holbrooke is perhaps best known for his leadership in putting together the 1995 Dayton Accords, which formally ended the conflict in Bosnia-Herzegovina. Though widely praised in some circles for his efforts, Holbrooke remains quite controversial for his role. For instance, the agreement allows Bosnian Serbs to hold on to virtually all of the land they had seized and ethnically cleansed in the course of that bloody conflict. Indeed, rather than accept the secular concept of national citizenship that has held sway in Europe for generations, Holbrooke helped impose sectarian divisions that have made the country – unlike most of its gradually liberalizing Balkan neighbors – unstable, fractious, and dominated by illiberal ultra-nationalists.

As with previous U.S. officials regarding their relations with Iraq’s Saddam Hussein and Panama’s Manuel Noriega, Holbrooke epitomizes the failed U.S. policy toward autocratic rulers that swings between the extremes of appeasement and war. For example, during the 1996 pro-democracy uprising in Serbia Holbrooke successfully argued that the Clinton administration should back Milosevic, in recognition of his role in the successful peace deal over Bosnia, and not risk the instability that might result from a victory by Serb democrats. Milosevic initially crushed the movement. In response to increased Serbian oppression in Kosovo just a couple years later, however, Holbrooke became a vociferous advocate of the 1999 U.S.-led bombing campaign, creating a nationalist reaction that set back the reconstituted pro-democracy movement once again. The pro-democracy movement finally succeeded in the nonviolent overthrow of the regime, following Milosevic’s attempt to steal the parliamentary elections in October 2000, but the young leaders of that movement remain bitterly angry at Holbrooke to this day.

Scott Ritter, the former chief UN Special Commission (UNSCOM) inspector who correctly assessed the absence of weapons of mass destruction in Iraq and predicted a disastrous outcome for the U.S. invasion, observes that “not only has he demonstrated a lack of comprehension when it comes to the complex reality of Afghanistan (not to mention Pakistan), Holbrooke has a history of choosing the military solution over the finesse of diplomacy.” Noting how the Dayton Accords were built on the assumption of a major and indefinite NATO military presence, which would obviously be far more problematic in Afghanistan and Pakistan than in Europe, Ritter adds: “This does not bode well for the Obama administration.”

Ironically, back in 2002-2003, when the United States had temporarily succeeded in marginalizing Taliban and al-Qaeda forces, Holbrooke was a strong supporter of redirecting American military and intelligence assets away from the region in order to invade and occupy Iraq. Obama and others presciently criticized this reallocation of resources at that time as likely to lead to the deterioration of the security situation in the country and the resurgence of these extremist groups.

It’s unclear, then, why Obama would choose someone like Holbrooke for such a sensitive post. Indeed, it’s unclear as to why – having been elected on part for his anti-war credentials – Obama’s foreign policy and national security appointments have consisted primarily of such unreconstructed hawks. Advocates of a more enlightened and rational foreign policy still have a long row to hoe.

International Law and Israel’s War on Gaza

When the Oslo Document was originally presented by the Israeli government to the Palestinian Delegation to the Middle East Peace Negotiations in the Fall of 1992, it was rejected by the Delegation because it obviously constituted a bantustan. This document carried out Menachem Begin’s disingenuous misinterpretation of the Camp David Accords–expressly rejected by U.S. President Jimmy Carter–that all they called for was autonomy for the people and not for the land too.

Soon thereafter, unbeknownst to the Delegation and to almost everyone else, the Israeli government opened up a secret channel of negotiations in Norway. There the Israeli government re-presented the document that had already been rejected by the Palestinian Delegation in Washington, D.C. It was this document, with very minor modifications, that was later signed at the White House on 13 September 1993.

Before the signing ceremony, I commented to a high-level official of the Palestine Liberation Organization: “This document is like a straight-jacket. It will be very difficult to negotiate your way out of it.” This PLO official agreed with my assessment and responded: “Yes, you are right. It will depend upon our negotiating skill.”

Of course I have great respect for Palestinian negotiators. They have done the best they can negotiating in good faith with the Israeli government that has been invariably backed up by the United States. But there has never been any good faith on the part of the Israeli government either before, during or after Oslo. Ditto for the United States.

Even if Oslo had succeeded, it would have resulted in the imposition of a bantustan upon the Palestinian People. But Oslo has run its course! Therefore, it is my purpose here today to chart a NEW DIRECTION for the Palestinian People to consider.

An agenda for an international legal response:

First, we must immediately move for the de facto suspension of Israel throughout the entirety of the United Nations System, including the General Assembly and all U.N. subsidiary organs and bodies. We must do to Israel what the U.N. General Assembly has done to the genocidal rump Yugoslavia and to the criminal apartheid regime in South Africa! Here the legal basis for the de facto suspension of Israel at the U.N. is quite simple:

As a condition for its admission to the United Nations Organization, Israel formally agreed to accept General Assembly Resolution 181 (II) (1947) (partition/Jerusalem trusteeship) and General Assembly Resolution 194 (III) (1948) (Palestinian right of return), inter alia. Nevertheless, the government of Israel has expressly repudiated both Resolution 181 (II) and Resolution 194 (III). Therefore, Israel has violated its conditions for admission to U.N. membership and thus must be suspended on a de facto basis from any participation throughout the entire United Nations System.

Second, any further negotiations with Israel must be conducted on the basis of Resolution 181 (II) and its borders; Resolution 194 (III); subsequent General Assembly resolutions and Security Council resolutions; the Third and Fourth Geneva Conventions of 1949; the 1907 Hague Regulations; and other relevant principles of public international law.

Third, we must abandon the fiction and the fraud that the United States government is an “honest broker.” The United States government has never been an honest broker from well before the very outset of these negotiations in 1991. Rather, the United States has invariably sided with Israel against the Palestinians. We need to establish some type of international framework to sponsor these negotiations where the Palestinian negotiators will not be subjected to the continual bullying, threats, harassment, intimidation and outright lies perpetrated by the United States government.

Fourth, we must move to have the U.N. General Assembly impose economic, diplomatic, and travel sanctions upon Israel pursuant to the terms of the Uniting for Peace Resolution (1950), whose Emergency Special Session on Palestine is now in recess.

Fifth, the Provisional Government of the State of Palestine must sue Israel before the International Court of Justice in The Hague for inflicting acts of genocide against the Palestinian People in violation of the 1948 Genocide Convention!

Sixth, An International Criminal Tribunal for Israel (ICTI) can be established by the UN General Assembly as a “subsidiary organ” under article 22 of the UN Charter. Article 22 of the UN Charter states the UN General Assembly may establish such subsidiary organs as it deems necessary for the performance of its functions. The purpose of the ICTI would be to investigate and Prosecute suspected Israeli war criminals for offences against the Palestinian people.

On January 4, 2009, Nobel Peace Laureate, Mairead Maguire wrote to the UN Secretary General, Ban Ki-Moon and Father Miguel D’Escoto President of United Nations General assembly adding her voice to the many calls from International Jurists, Human rights Organizations, and individuals, for the UN General Assembly to seriously consider establishing an International Criminal Tribunal for Israel in view of the ongoing Israeli atrocities against the people of Gaza and Palestine.

Obama airstrikes kill 22 in Pakistan

Islamabad is the first to get a taste of the president’s ‘tough love’ policy

PAKISTAN received an early warning of what the era of “smart power” under President Barack Obama will look like after two remote-controlled US airstrikes killed 22 people at suspected terrorist hideouts in the border area of Waziristan.

There will be no let-up in the military pressure on terrorist groups, US officials warned, as Obama prepares to launch a surge of 30,000 troops in neighbouring Afghanistan. It is part of a “tough love” policy combining a military crack-down with diplomatic initiatives.

The Pakistani government, which received a visit from General David Petraeus, the chief of US Central Command, on the day of Obama’s inauguration, has been warned that it must step up its efforts against militants if it is to continue to receive substantial military aid from America.

The airstrikes were authorised under a covert programme approved by Obama, according to a senior US official. It was a dramatic signal in the president’s first week of office that there will be no respite in the hunt for Al-Qaeda and Taliban leaders.

However, Obama aims to win hearts and minds in the region by tripling the nonmilitary aid budget to Pakistan and encouraging reconciliation and reconstruction efforts in Afghanistan as a component of the surge.

Hillary Clinton, the secretary of state, said during her Senate confirmation hearing: “We will use all the elements in our power – diplomacy, development and defence – to work with those . . . who want to root out Al-Qaeda, the Taliban and other violent extremists.”

Clinton pledged that a mix of active diplomacy and strong defence, which she described as “smart power”, would help to restore US leadership in foreign policy.

The airstrikes are deeply resented in Pakistan, where enthusiasm for Obama is said to be lower than in any other Muslim country.

Shuja Nawaz, a Pakistani who runs the South Asia centre of the Atlantic Council, a Washington think tank, said Obama had to do more than lob missiles at Pakistan.

“He can’t just focus on military achievements; he has to win over the people.” Nawaz added that it was important to set conditions in return for aid because “people are more cognisant of the need for accountability – for ‘tough love’ ”.

Increased military cooperation from Pakistan is a vital part of the surge, according to diplomatic sources who fear the efforts in Afghanistan will be wasted if terrorists can operate with relative ease from bases across the border.

Obama is also ramping up the pressure on Hamid Karzai, the Afghan president, who is increasingly viewed as an obstacle to progress and faces reelection this year.

“We’re going to need more effective government and a more effective drive against corruption coming from the leadership in Kabul if the Nato effort is to be sustainable,” said a senior British official.

Richard Holbrooke, 67, a veteran diplomat known as “the bulldozer”, was appointed as a special envoy to Afghanistan and Pakistan last week.

“Nobody can say the war in Afghanistan has gone well,” Holbrooke said when his appointment was announced.

Obama last week delivered the warning that Afghanistan and Pakistan were the “central front” in the war on terror.

“There is no answer in Afghanistan that does not confront the Al-Qaeda and Taliban bases along the border,” he said, “and there will be no lasting peace unless we expand spheres of opportunity for the people of Afghanistan and Pakistan.”

The Pentagon has acknowledged that it needs to define its strategy in the region.

Robert Gates, who has retained his job as defence secretary, said last week: “One of the points where I suspect both administrations come to the same conclusion is that the goals we did have for Afghanistan are too broad and too far into the future.”

Gates said America needed to set more “concrete goals” for Afghanistan that could “be achieved realistically within three to five years”.

He described these goals as reestablishing Afghan government control in the south and east of the country, and delivering better services to its people.

In a sign that there may be turf wars to come between the State Department and the Pentagon, Clinton said she wanted diplomats rather than military officers to hand out aid, set up schools and encourage political reconciliation – a break from the counter-insurgency strategy pursued in Iraq under Petraeus.

Missiles fired from suspected US drones killed at least 15 people inside Pakistan today, the first such strikes since Barack Obama became president and a clear sign that the controversial military policy begun by George W Bush has not changed.

Security officials said the strikes, which saw up to five missiles slam into houses in separate villages, killed seven “foreigners” – a term that usually means al-Qaeda – but locals also said that three children lost their lives.

Dozens of similar strikes since August on northwest Pakistan, a hotbed of Taleban and al-Qaeda militancy, have sparked angry government criticism of the US, which is targeting the area with missiles launched from unmanned CIA aircraft controlled from operation rooms inside the US.

The operations were stepped up last year after frustration inside the Bush administration over a perceived failure by Islamabad to stem the flow of Taleban and al-Qaeda fighters from the tribal regions into Afghanistan. Mr Obama has made Afghanistan his top foreign policy priority and said during his presidential campaign that he would consider military action inside Pakistan if the government there was unable or unwilling to take on the militants.

The strikes come just a day after Mr Obama appointed Richard Holbrooke, a former UN ambassador, as a special envoy for the region.

Eight people died when missiles hit a compound near Mir Ali, an al-Qaeda hub in Pakistan’s North Waziristan region. Seven more died when hours later two missiles hit a house in Wana, in South Waziristan. Local officials said the target in Wana was a guest house owned by a pro-Taleban tribesman. One said that as well as three children, the tribesman’s relatives were killed in the blast.

Pakistan has objected to such attacks, saying they are a violation of its territory that undermines its efforts to tackle militants. Since September, the US is estimated to have carried out about 30 such attacks, killing more than 220 people.

A claim by US forces in Afghanistan that they killed 15 Taliban fighters in the eastern province of Laghman, has been disputed by village elders.

A US statement said on Saturday that soldiers killed the fighters after coming under fire from opposition fighters.

But the elders say all those who died were civilians.

“The operation in Mehtar Lam District, approximately 60km northeast of Kabul City, targeted a Taliban commander believed to conduct terrorist activities throughout the Kabul, Laghman and Kapisa provinces,” a US military statement said.

“As coalition forces approached the wanted militant’s compound, several groups of armed militants exited their homes and began manoeuvering on the force.”

Nine fighters were killed by small-arms fire and four killed by “precision close-aire support”, the statement said, adding that two other fighters were killed during a subsequent serach of the houses in the compound.

‘Civilians killed’

One of the attackers killed in the initial fight was later identified as female, the US military statement said.

But Hamididan Abdul Rahmzai, head of the provincial council in Laghman, said village elders had told him in the hours after the raid that those killed were civilians.

Rahmzai relayed questions from the Associated Press news agency to the village elders directly, who responded by saying that swear on the Quran that all those killed were innocent.

They said that women and children were among the dead, and told Rahmzai that they have no link to Taliban fighters.

Independent assessment by journalists and human-rights monitors of the competing claims is complicated by the level of danger in the territory to unarmed outsiders.

Competing claims

While Afghan villagers have been accused of inflating civilian death claims to receive more compensation, the US military has in the past been charged with not fully acknowledging the deaths of civilians due to its raids.

In the immediate wake of a battle in August in the village of Azizabad, the US military said no civilians were killed.

Eventually a US investigation found that 33 civilians had been killed in that raid.

The Afghan government and the UN said that 90 civilians died in the incident.

Hamid Karzai, the president of Afghanistan, said last week that the US and countries serving in the Nato military alliance are continuing air raids in civilian areas, despite his call for them to stop.

Kabul recently sent Nato headquarters a draft agreement that would give Afghanistan more control over future Nato deployments in the country.

The draft also says that Nato troops should no longer conduct searches of Afghan homes.

The US military is facing a stern challenge in maintaining order in Afghanistan in the face of a resurgent Taliban.

Extra troops

US marines are ready to leave Iraq quickly so that 20,000 soldiers can be sent to Afghanistan, James Conway, Marine Corps commandant, said on Friday.

“The time is right for marines to leave Iraq,” the senior marine officer said.

About 2,200 marines are currently serving in Afghanistan, as part of the 34,000-strong US military contingent there.

In all, US military planners are expected to deploy a total of 30,000 extra troops to the country in the next 12 to 18 months, reflecting the emphasis that Barack Obama, the US president, is putting on the war in Afghanistan.

And while the US prepares to boost its forces, Karzai is coming under international pressure over the efficacy of his leadership.

“They have been holding on to Karzai in the hope of bringing about some semblance of governance in Afghanistan but recently Nato secretary-general Jaap de Hoop Scheffer said that the problems in Afghanistan stem from governance rather than from terrorism,” Imtiaz Gul, a political analyst in the Pakistani capital Islamabad, told Al Jazeera.

“If we are to go by what Scheffer says, Karzai’s days are numbered. There are going to be very tough elections in Afghanistan in the next few months.”

Gazing On Gaza

The pale moon ruled over my last three nights in Hawaii, laying a magical veneer over an already perfect landscape. As I watched it from the 25th floor lanai (balcony), I wondered if it was refusing to shine over Gaza, so as not to witness a continuing inhumanity of human beings upon human beings.

Years ago, I used to wonder how Israel could do what it was doing to the Palestinians, or even to ally itself with the apartheid government of White South Africa – but since then, I’ve seen the abused take on the persona of the abuser – prisoners doing the guards’ work, women maligning other women – all to align themselves with brute authority. Underlying the repetitive cycle of violence is survival at all costs – and Israel has bluntly used and overused this to justify the most extreme measures taken against a people whose land and patrimony it expropriated in successive acts of violence.

The siege of Gaza underscores the senselessness of what has gone on with the Palestinians: the assault began for no reason, continues with no clear far-reaching objective and ends without any goal reached. Population control, perhaps?

For the last 50 years, Israel has gotten away with this by stoking the guilt feelings of the West by elevating victimhood as the hallmark of its history. The Germans, if for nothing else, owe the Palestinians a great debt of gratitude for having taken their place as villains in Israel’s self-image as victim and for enduring collective punishment for a Holocaust they did not commit.

Deeper still, behind all these surface relationships, lies the Bush administration’s determination to leave as much of a mess as possible for the new political leadership. Make no mistake about it: this was Bush’s last war. Israel would not have embarked on this silly adventure without a go-signal from the US government. It was a last flip of the finger to the people of the US – to the millions who marched against the invasion of Iraq and those who now march against the siege of Gaza.

There are those who leave an office or a residence neat and clean, ready for the next occupant; there are those who improve on what they find and leave behind potential for even greater achievement; and there are those who make sure that they’ve thoroughly messed up the terrain so that it would be impossible to accomplish, much less change, anything. Legacies are determined not simply by accomplishment but what doors have been opened, what new pathways have been created, what possibilities have been made clear… Bush’s legacy is a complicated political terrain that leaves his successor very little maneuverability.

The old leadership refuses to let go while the new hasn’t crystallized a vision for how it will govern. And we are all held hostage at this between the intake of breath and its release.
