Delhi Encounter: Indian Muslims demand probe

Text of the press release issued by COORDINATION COMMITTEE OF INDIAN MUSLIMS at the Press Conference on the current issue “Terrorism and Muslims’ Stand” at the New Delhi, Press Club on 22 September 2008

The Coordination Committee of Indian Muslims, representing all major Indian Muslim organizations is an ad hoc high level committee set up to deal with the current terrorism scare aiming the Muslim community in India.

The committee expresses its sorrow and grief at the untimely death of Inspector Mohan Chand Sharma during the encounter in Jamia Nagar’s Batla House on 19 September. The community offers its sincere condolences to his family.

The committee reiterates that Islam and Muslims are fundamentally opposed to terrorism as Islam and its holy book, The Qur’an, categorically forbids killing anyone unjustly and by unjust means. The Indian Muslim community through umpteen conferences and religious scholars and institutions, including the famous seminary of Darul UIoom at Deoband, has issued clear fatwas denouncing terrorism as an act totally forbidden in Islam. The Muslim community is opposed to terrorism whatever its source and shape.

We want to contribute to usher in a terror-free India. We believe that existing laws are sufficient to deal with this scourge. We clearly reject giving unlimited authority to the police. We, in particular, reject the legal sanctity to “confessions” given to the police and making bail applications more difficult for those accused of terrorism. No other law in India makes “confessions” to the police admissible in courts and this one must not be an exception. The Indian police, which normally resorts to third degree torture, is highly discredited in the eyes of the public. In all terrorism cases, where the police fails to file charge-sheets within a reasonable time-frame like six months, the accused should automatically get the right to apply for bail.

We feel that the Muslim community in general and the Muslim youths in particular are being targeted in the name of fighting terrorism. While security agencies should go about their work to secure the country from terror and make inquiries and arrest the accused and suspects, the same must not take place in an intimidating and insensitive manner. We are opposed to the insensitive style of the police functioning which creates terror and panic in the Muslim localities. We condemn the security and intelligence agencies’ rush to the media after any such incident with theories and conclusions before any real and proper investigation.

We also express our displeasure at the print and electronic media which blindly reproduces leaks attributed to unknown security agencies and starts blaming the Muslim community minutes after any terrorist incident. This leads to instability in the country and ill-will towards the whole Muslim community.

We demand that whenever police undertakes a combing or search operation in any Muslim locality, at least one third of the raiding force must consist of officers belonging to the minority community, and minority elders of the affected area should be taken into confidence and made part of the inquiry and interrogation teams. Such operations must not look like a patently anti-Muslim exercise. This will restore some credibility to the discredited police and security agencies.

We make it clear that the style of provocative searches and encounters is unacceptable in a democratic society. It always smacks of a preplanned conspiracy and betrays the police’s inability or unwillingness to face courts of law. More specifically, we reject the Batla-house style of encounter killings. We fail to understand why the alleged terrorists were not caught alive. People in the area believe that it was a fake encounter, that it was a one-sided and pre-planned affair. With this encounter the police has discovered a new “mastermind” for all the explosions in the past which means that India will no longer face terrorist blasts. We demand a high-level judicial inquiry into the Batla House encounter so that all facts may come out.

We also demand stringent action including immediate ban against Hindutva terrorist outfits, especially VHP, Bajrang Dal, Shri Ram Sena, Hindu Munnani, Hindu Jagran Manch, Yuva Hindu Vahini, Hindu Janajagruti Samiti and Durga Vahini etc, which are targeting Muslim and Christian communities in a number of states. We are unable to understand why the government and security agencies are unable to proceed against Sangh Parivar outfits which have been caught red-handed in acts of terrorism and making bombs. We also demand the government to probe all possible angles of terrorism in India, including local and foreign forces which benefit from instability and chaos in India.

POLITICS-INDIA: Polls Uncertain With Jammu Divided From Kashmir

SRINAGAR, Sep 21 (IPS) – Plans by the central government to conduct elections in Jammu and Kashmir, due originally in November, remain uncertain because of the serious regional and religious differences that have cropped up between the two main regions that make up the composite territory.

Relations between Hindu-majority Jammu and the Muslim-dominated Kashmir valley have been souring since May over a move to transfer forest land to a board that manages a popular, annual pilgrimage to the Hindu cave shrine of Amarnath, deep in the Kashmir Himalayas.

Agitations over the controversial move resulted in the regional People’s Democratic Party (PDP) withdrawing support to the coalition government led by chief minister Ghulam Nabi Azad of the Congress party and the state being placed under direct central rule on Jul. 7.

And now, the federal government, the election commission, political parties and civil society leaders are unable to agree on when to schedule elections for a new state assembly.

“I don’t think holding elections would be a good thing to do at a time when the state is passing through a difficult situation. The entire state is on edge due to the communal and regional tension. I reckon that it will cause the situation to deteriorate further,” Balraj Puri, a noted expert on the Kashmir conflict who is based in Jammu, told IPS.

“Let the situation calm down. I think an internal dialogue between the two regions should be started on a priority basis to bring about a rapprochement,” said Puri who favours autonomy for the different regions of the state.

Prof. Rekha Choudhary, who teaches political science at Jammu University, believes that by planning to hold elections the central government appeared to be insensitive to the serious regional polarisation that has occurred. ”I think holding elections in the state in the current circumstances would be a huge risk. We have never seen the kind of hostilities between the regions of the state like what exists today,” she said.

Choudhary said the central government seems to be driven by the belief that holding elections would help bridge the gap between the Jammu and Kashmir regions. “In Kashmir pro-freedom groups that have appealed for a total boycott of the elections are going to gain in popularity by capitalising on the popular mood of hostility against India. And in Jammu, the right-wing Bharatiya Janata Party (BJP) which favoured the land transfer to the Hindu shrine board, is going to benefit,’’ she said.

India’s Kashmir state is a classic example of linguistic and ethno-religious diversity and comprises the three distinct regions of Kashmir, Jammu and Ladakh. Together, these regions are known to the world as Indian Administered Kashmir.

About 55 percent of the state’s total population of 10 million is settled in the alpine Kashmir region, traditionally the seat of power. While 98 percent of the people who live in Kashmir are Muslim, Jammu’s population is 60 percent Hindu. Ladakh accounts for two percent of the total population.

About a third of the area of the former princely state Jammu and Kashmir is under the administration of Pakistan.

In 1989, people in Muslim-dominated Kashmir began an armed struggle in favour of freedom from India and this spilled over into the Muslim areas of Jammu.

Political analysts say the mistrust between the Jammu and Kashmir regions has been brewing for a long time. The people and leaders of these regions have been competing for central developmental funds and prized positions in administration.

“The government of India never tried to evolve a mechanism to hold all the regions together in order to give them a feeling of belongingness. It never had a focused policy regarding Kashmir and was keen on installing puppet regimes in the state which would serve its own interests,” observes Gul Mohammad Wani who teaches political science at Kashmir University.

“Jammu region is demanding a greater share in power which, according to them, has always remained centred in Kashmir. On the contrary, people in the Kashmir region are demanding complete freedom from India,” Wani said.

Observers say that if the elections are not held by November, they will have to be postponed till April given the harsh winter in Kashmir and Ladakh. Out of a total of 87 assembly constituencies, a majority of them, 50, fall in Kashmir.

Most political parties prefer to delay polls till next year. The exception remains the pro-Hindu BJP which may benefit from the communal divisions, especially in Jammu.

“We suggest that congenial conditions be created for holding elections before announcing election dates,” says Omar Abdullah, president of the pro-India National Conference party. His viewpoint is shared by Mehbooba Mufti, leader of the PDP which also favours Kashmir remaining a part of India.

At least 42 people died during the agitations against the land transfer with the movement quickly morphing into revival of calls for freedom from Indian rule — not heard for the last five years.

Suspicions between the two regions worsened after traders in the Kashmir region announced snapping of relations with their Jammu counterparts in reaction to what they called “economic blockade” of their region by the people of Jammu during the agitation.

Kashmir receives essential supplies and exports its produce to markets in India solely through the 300 km-long Jammu-Srinagar highway.

“How can we think of maintaining trade ties with the traders from Jammu when they were party to the recent economic blockade of Kashmir by the people of Jammu,” says president of the Kashmir Chamber of Commerce and Industries (KCCI) Mubeen Shah. “The wounds, inflicted by the economic blockade of Kashmir, will take a lot of time to heal up’’

According to economists, boycotting trade with Jammu would mean immense loss to traders on both sides.

“Kashmir’s total trade is estimated at Rs 520 billion (11.3 billion US dollars) per annum out of which the yearly trade exchange between the Kashmir and Jammu regions is Rs 270 billion (six billion dollars),” says Prof. Nissar Ali who teaches economics at Kashmir University.

Traders in Kashmir have now intensified their demand for reopening the Srinagar-Muzaffarabad road, which connects Indian Kashmir with the Pakistan administered part.

Before Pakistan and India grabbed control of parts of Jammu and Kashmir in 1947, the Srinagar-Muzaffarabad road served as the main link between Kashmir and the markets of Rawalpindi in Pakistan and beyond.

On Aug. 11, thousands of Kashmiri traders and common people took out a symbolic march towards Muzaffarabad, the capital of Pakistan administered Kashmir, to assert this demand. At least five people were killed and many others injured when police, stopped the march by opening fire some 20 km ahead of the Line of Control, the de-facto border between the Indian and Pakistani parts of Kashmir.

Anil Raina chronicles the recurrence of Kashmir’s freedom cries from generation next

Till last summer, Kashmir had managed to reclaim its status of a tourist’s hub. Hotels were booked till year end, business was picking up after years of turmoil and it seemed that good times were returning to the Valley.

People were coming to terms with the pain of loss and getting over the fatigue of being hapless victims of 19 years of strife. At the time, no one knew that the situation would change so dramatically and so soon. Today, the state resembles the days of early militancy. The air is once again rent with calls for Azadi and the baton of freedom struggle has once again been passed from one generation to the other, with even children participating in the movement.

AN AUGUST MARCH

The march in Srinagar’s Muzaffarbad Road on August 22 looked like an ocean of people covering the highway from Pattan to Sheeri: a generation of young men, who were toddlers in 1990 when Kashmir exploded with massive public demonstration, was leading the procession. The security forces had withdrawn after failing to halt this march at 10 different places. Hurriyat leader Sheikh Aziz was killed on August 11, which lent fuel to the movement. Aziz’s killing during the Muzaffarbad Chalo march organized by the Kashmir based separatist groups and supported by People Democratic Party (PDP) made the situation volatile. People in the valley came out on the streets and started demanding instant Azadi (freedom) angered by what they called a cold-blooded murder by the security forces.

Following this, all of Kashmir had erupted; dozens of people were killed in police firing and soon the Valley took on a different hue from what it was two months ago when the only buzz in the air was of election rallies, a pleasant spring and thousands of tourists. The People’s March at Srinagar’s Muzaffarbad Road changed all that. “We will not stop. We have to cross the LoC. We have to re-unite Kashmir,” said Abdul Rasheed Dar, a peace-loving businessman until now. “Kashmir has woken up. The movement is alive again.”

UNITED THEY STAND

For the first time, a million Kashmiris assembled in Eidghah last month at the call of the Hurriyat to conduct a rally to voice their demand for a free Kashmir. The rally lasted for 12 hours. Earlier it was a fight for leadership and ideology between the several extremist groups such as JKLF, People League, Dukhtaran-e-Millat and others, but following the Amarnath land row, they have melted their differences and become united with a single point agenda of making Kashmir an independent country. The stage was shared by hardliners such as Syed Ali Shah Geelani, and the merger was named the Co-ordination Committee. Hurriyat Chirman Syed Ali Shah Geelani wanted an end to the dialogue with the Centre, demanding trilateral talks involving Pakistan. The hardliner wanted the moderate faction to launch an active boycott campaign in the forthcoming assembly elections and stop offering a resolution proposal on Kashmir to the Centre. “We cannot let go of the opportunity. If we fail to rise up to people’s expectations, they will never forgive us,” said a senior Hurriyat leader on condition of anonymity. “Only a united Hurriyat will be in any position to lead and maintain the current momentum.

“We have seen the beginning of militancy in our Valley through the ’90s. We have seen the crisis during the first elections in 1996 and as members of the minority community we still survived by sheer determination of not abandoning our heaven but now we shall pay the price for being on the other side of extreme militancy engineered by own brethren in our own land,” says a distraught Pran Nath Koul, a school teacher, who managed to stay in the Valley despite decades of militancy, but could not stand the threat caused by the mobilization of erstwhile lower heads of extremist Jehadi groups in the wake of Amaranth land row. Koul did not sleep at night just to guard his wife and three children from those who protected him even in adverse crisis. Koul’s family is one of the over 1,500 Hindu families who were not targeted by extremist Islamic Militants even through that time in the last 20 years.

BUSINESS FIRST

Koul’s sentiments are seconded by several Hindu families in the Valley who feel that their own Hindu brethren have left them fighting a cause that was never their own. Had their brothers in Jammu for the first time in the history of Jammu and Kashmir not blocked the economy of Kashmir after the Amaranth land row, they would still continue to live in peace.

“Whatever the people are doing is the manifestation of their anger against the government of India,” said senior Hurriyat Leader Bilal Lone. Sahil-ul-Islam, political advisor to Hurriyat chairman Merwaiz Umer Farooq said, “We have repeatedly informed Delhi about the anger in the new generation. The Kashmir issue remains unaddressed but they can’t take every Kashmiri for a ride as they did before. Mobilization is the only answer.

“Unity is the need of the hour and that is why the leadership is united once again and we just want to channelize it and carry out a peaceful, non-violent movement, keeping the aspiration of the people of Kashmir in mind. The bandage approach of the people of India is no longer needed and we want the issue to be resolved for once and for all,” said Hurriyat chairman Merwaiz Umer Farooq. The 32-year-old is considered a moderate Kashmiri separatist leader  and has a strong base in the Bakra community. The Bakras are traditionally well-to-do people based in Srinagar, and have been at the forefront of anti-India politics in Kashmir.

Sajad Bhat, an apple supplier whose business was hit by the blockade on the highway because of which his produce could not be transported for 10 days and suffered great loses said, “So far it was a battle between Jammu and Kashmir and with rest of India, but now it has become too personal. My driver, who was delivering fruits to a Delhi market, was beaten so badly that I had to compensate their family despite incurring huge loses in business. I do not believe in massacring those responsible for the economic blockade, but in future if this continues, I have no option but to support the cause of fellow businessmen who for no fault of theirs have become victims of vote bank politics.”

However, the point in question is not about individuals gains or loses, says Riyaz Khan a chemist in Srinagar who has been in business since 10 years. “I never used to visit religious meetings since I believe that the protector is bigger than the destroyer; I would not even have participated in rallies until my business got hampered. I have got six people to feed from the profits that I earn from the shop. I used to get adequate supplies from the distributors before the road was blocked. I could not support my family for those 10 days when my people were dying for the medicines that could have saved their lives,” he says.

The political leadership of all hues in the Valley is in a dilemma. Rendered ineffective by the mass upsurge, they are unsure about the way out of this situation which most of them felt was too serious. A senior leader said that dialogue was the only way out. But he has no clue where and how to get started. “If India and Pakistan fail to include Kashmiris in the dialogue process, we will be forced to launch non-violent agitation in Kashmir,” rounded off JKLF Chief Yasin Malik.

Thousands protest Indian rule in Kashmir

SRINAGAR, India, Sept 19 (Reuters) – Shouting anti-India slogans, thousands of Muslims marched in Kashmir’s main city on Friday, part of an ongoing campaign against New Delhi’s rule that has become an embarrassment for the Indian government.

The current round of protests are some the biggest since a separatist revolt broke out in the disputed Himalayan region in 1989, a conflict that has killed thousands of people.

Thousand of policemen and soldiers were deployed across the region ahead of protests called by Muslim separatists after Friday prayers.

“Go India go, we want freedom,” shouted protesters led by separatist leader Yasin Malik in Srinagar, Kashmir’s summer capital.

At least 37 protesters have been killed by government forces since last month in the Muslim-majority Kashmir Valley. More than 1,000 people have been injured.

The protests were sparked by a government decision to grant land to build shelters for Hindu pilgrims travelling to Kashmir, one of the world’s most militarised regions.

Shops, businesses and schools were closed on Friday and streets in the strife-torn region wore a deserted look. Only security patrols were on the roads.

“I appeal to people to protest peacefully,” Malik told the protesters, many of them carrying his picture.

The protests come at a time when violence involving Indian troops and separatist guerrillas has declined significantly after India and Pakistan, who claim the region in full and have gone to war over it, began a slow-moving peace process in 2004.

Srinagar, September 18 (Newsline Monitoring Desk):  Arundati Roy, noted human rights activist and writer, in an interview, has suggested “the time has come for the people of Kashmir to ask for Azadi (freedom) from India”

“I think it’s the biggest chance Kashmiris have had in their struggle for Azadi in a very long time” she however said she is skeptical that “a spontaneous uprising can ‘down-rise’ just as spontaneously as it ‘up-rose’ and hence the people need to act fast”

Calling the security forces as “state forces” Arundhati opined the minute people retreat, these forces will take back the streets. “People cannot go on forever without a clear idea of where it’s all going. Right now the Coordination Committee is very fragile and the Intelligence Agencies are trying very hard to break it up” she said.

Arundati said New Delhi has still not learnt its lesson and instead used the same old methods to deal with the situation in Kashmir. “I don’t think the Indian state is even now willing to listen to what people are saying” she said “It is trying to work out a way to defuse the situation and how to manage crowds and send them back home”

The booker prize winner writer believes India does not want the vicious cycle of violence to end in Kashmir. “The United Jehad Council has unanimously declared that militants must silence their guns. But the Deep State in India wants nothing more than the return of an armed militancy” she averred “So if real militants don’t appear, I think the Deep State will manufacture some”

Arundati maintained that as a right thinking person of the society she will always try to speak out and reveal the truth about issues. Emphasising that sentiments of Kashmiris be respected she said “Some people said I should be charged for the offense of sedition. If so it implies millions of Kashmir’s should be charged too. Instead if only I am charged and not them, it would mean a tacit acceptance of the fact that Kashmir is not a part of India”

While stressing that anybody who has ever walked the streets of Srinagar cannot but see the moral legitimacy of what people are demanding she said “It’s the least I could do for those who have faced so many years of terror, torture and disappearances. I don’t think there could be a single Kashmiri in the valley who has not been humiliated in some way by the occupation

Unarmed Kashmiri freedom fighters

Kashmiri Muslims have broken new ground by waging a non-violent separation struggle but the Indian authorities seem unsure how to respond

Flowing black beard, a headband with “Allahu akbar” (God is great) and a fluttering green flag. This has been the trademark picture of the recent azadi (freedom) processions of Kashmir, where hundreds of thousands marched the streets of this disputed Himalayan region seeking a separation from India.

From a distance, it seems as if the past has returned to Kashmir. But the present contains an irrefutable truth: in place of guns, the people carry slogans. The politics of protest this time is not about the argument of power, but about the power of argument.

Kashmir is the first conflict-ridden Muslim region in the world where people have consciously made a transition from violence to non-violence, and this includes the staunch Islamists too. In fact, the wisdom behind the use of arms to fight a political struggle was being silently debated within Kashmir ever since 9/11 blurred the lines dividing terrorism and genuine political movements. The deteriorating situation inside Pakistan too had tilted the balance towards a peaceful struggle.

Thus when Kashmiris decided to come out to demand azadi recently, there were no militant attacks or suicide bombings. It was through massive unarmed processions where people shouted slogans and waved flags. And when the government tried to halt them, the anger was only manifested through stone pelting. Sensing the overwhelming public mood, the militant groups immediately declared a unilateral ceasefire, admitting the insignificance of the gun for an unarmed people’s movement.

This major shift has not been registered even as it has already formed a new discourse for Kashmir’s separatist struggle. New Delhi’s response was usual – it again used its iron fist, killing 38 unarmed protesters and injuring more than a thousand and enforcing a strict curfew with a hope that the people will be ultimately cowed down. The separatist leadership too was rounded up.

This only shows that New Delhi is misreading the script. This time the authorities are not faced with gun-wielding men but unarmed people. A heavy clampdown keeping the population indoors only puts a temporary lid on the seething anger. Instead of a military intervention, New Delhi should have immediately attempted sincere political and democratic means to engage Kashmir and calm the tempers.

New Delhi’s approach to handling Kashmir for past two decades has been simple and straight: militancy is the only problem and that can be sorted out by stringent military measures. Though there have been several rounds of negotiations with a faction of the separatist leadership too, New Delhi used the process more as a photo-op than a serious effort to address the demands of the people. There have been half a dozen occasions when separatist leadership joined a dialogue with New Delhi to resolve the Kashmir problem amicably – only to find the exercise nothing more than a surrender and thus futile.

The distrust towards New Delhi had reached such proportions that when moderate separatist leader Mirwaiz Umar Farooq decided to join talks with New Delhi, his uncle was murdered in Kashmir. Despite a serious threat to his life, he joined the talks directly with the prime minister of India. Again, the non-serious approach of New Delhi derailed the process, further eroding the credibility of talks with New Delhi in the eyes of Kashmiris. The public standing of separatist leaders who had agreed to talk to New Delhi also diminished substantially.

The recent protests by hundreds of thousands of unarmed people too don’t seem to have changed the mindset of New Delhi’s ruling elite. Instead of acknowledging the intensity of the uprising and the depth of the sentiment in Kashmir, New Delhi again refuses to face the reality and delays engaging in a sincere dialogue with the separatist leadership. The Kashmiris have overwhelmingly announced that peaceful processions and not guns are now their favoured means of protest. This needs to be encouraged and allowed to take firm roots because it could help to put an end to the bloodshed in Kashmir and make an amicable resolution of the problem easy. The phenomenon could also have a positive influence over a dozen such violent conflicts in other Muslim regions across the world. But if peaceful protests are crushed like armed movements, another wave of violence will take root, reinforcing the idea that the gun is mightier than a slogan.

Newton’s Third Law of Motion now has nearly as neat a political parallel. Every non-state terror strike against human lives leads to an opposite and often more than equal state assault on human rights. The New Delhi blasts of September 13 have led to no different a sequel.

India has witnessed ten major serial explosions of this kind in the post-9/11 period, excluding the still mysterious attack on the country’s parliament on December 13, 2001, and militant offensives mainly targeting the army and security forces. The fallout of the calamity, which has become frequent and familiar, has been predictable every time. The reaction to terror-wrought tragedies, from powerful sections of the political spectrum and, particularly the far right, has been remarkably the same and twofold.

Every time, even before the blood at the site has dried and bodies are being counted, the far right and its friends – as well as even some of its avowed foes that are not free from its influence – hasten to point fingers at the usual suspects. No investigations are deemed necessary before “Islamic terror” is indicted, and the culprit is identified as “cross-border terrorism,” aided and abetted by local “sleeper cells.”

The second reaction, which follows within a split second, is to demand “more stringent anti-terror laws,” with less rights for the often arbitrarily accused than allowed under law for even a common criminal. Without severe curbs on human rights, it is asserted, inhuman terrorism cannot be combated.

The story has been repeated after the five blasts in crowded and central areas of New Delhi, claiming a toll of 22 lives so far and seriously injuring at least 98. The Bharatiya Janata Party (BJP), the political front of the parivar or the far-right “family,” in fact, has outdone itself on this occasion. And for a good reason. Assembly elections are coming soon in New Delhi and other states, while the country’s general election is due in early 2009.

A couple of anti-minority riots have always been the party’s preferred method of campaigning for elections. The New Delhi explosions have given it on a platter a divisive issue of its heart’s desire.

BJP leader and former deputy Prime Minister Lal Krishna Advani surprised no one by calling immediately for a stringent “anti-terror law” again. He added two riders to the demand. He upheld, in the first place, such a law passed by the assembly in the State of Gujarat as a model for the rest of the nation. The Gujarat Control of Organised Crime (GUJCOC) Bill is a brainchild of Chief Minister Nerendra Modi, whose name is written in golden letters in the annals of a grateful Indian fascism, for the grisly anti-minority pogrom six years ago. Advani shared Modi’s indignation at New Delhi sitting on the bill and stalling its enactment.

Who doesn’t know how the Capitalist social order has worked from day one?—

By first causing monumental social upheavals in the pursuit of profit maximization, then recommending quick-fixes guaranteed to spawn still worse upheavals so that more profitable quick-fixes are in turn rendered “necessary.” And all these rooted in technologies of the newest kind that tell us what we always needed to solve our problems.

In those processes of declension, is it any wonder that the final quick-fix that we are offered should be the gun? After all, let us please remember that the biggest enterprise worldwide is the arms industry, and the biggest insurance for the continuance of this order of things not the end of warfare but its assured continuance in myriad forms and theatres. The better things get for the Capitalist class, the more they must remain the same for all the rest. And nothing ensures that result as well as warfare in perpetuity.

The coterminous “spiritual” trick that Capitalism of course employs is to ascribe all social upheavals to the “sinful” nature of man—those opposing Capitalism more sinful than others—rather than to its own ascertainable doings. An ancillary part of Capitalist ideology, so to speak, that then finds a central role for church, mosque, and temple, and takes the wretched of the earth away from either addressing rationally the sources of their condition or putting up a fight.

Thus it is that a resurgently Capitalist class in India is today howling for a new, “tough terror law” that would forever make propertied India safe for super-powerdom. Switch to any corporate TV channel, especially the ones in English, or read most corporate print media, or visit any upwardly-mobile urban elite home, and you will find but one strident recipe for fighting terror; namely, be like the terrorist and give them their own medicine. Only the Muslim terrorist of course, needless to say. Are there any others?

This would be fine if only it worked

The minute, however, you pose that question another ready answer follows: look at America—not a single terrorist strike there after “9/11”. Ergo, why can’t we be like America in every conceivable way, down to the colour of the toilet paper?

Not that we are not getting there, with the “strategic partnership” (read military collaboration) now in place, buttressed by junk consumerism, instinctual anti-Islamism/pro-Zionism, contempt for socialist ideas (retaining nonetheless the appellation “socialist” in the preamble of the Constitution, rather like the residual tailbone at the end of the human spine), a mighty embrace of an increasingly lethal majoritarian religiosity, professional therapy for stresses and tensions, the neighbourhood gym or godman as the answer to moral fatigue and vacuity, belief in infinite possibility for the “endowed” and karmic fate for the misery-ridden, waving the flag in the face of the sanest criticism and so forth.

Most of all, avoiding at all cost the reading of needlessly complex or critical materials that do not straightforwardly endorse the American life-style, or that drag us into considerations that have no understandable bearing on our corporate pay packages, or cloistered dens of comfort. Or, that dampen gratification with any insidious invitation to gravitas, or take our plastic smiles and sniggers away even for a bit. To wit, hey, why can’t we be like animals—kill, eat, defecate, copulate, and leave all the rest to god and nature. Gargantua, Gargantua, thou art the best.

It is another matter that, as we write, god and nature (Lehman and Hurricane Ike?) seem yet again confronted with the “spectre of Marx.” Although, be sure, we can well meet all that with a strike on some other part of the disloyal world, which, after all, remains happily full of “enemies” but with assets we can use. Why else are we “strategic partners” I ask you? Lehman may sink, but Pentagon is forever.

What freedom means in Kashmir

The newspaper headlines in the mainly Muslim valley in India-administered Kashmir say it all.

‘Freedom is sweet, no matter how it comes’, says one. ‘People pray for freedom,’ chimes another, reporting on Friday prayers in the valley.

A row over transferring land for a Hindu pilgrimage escalated into a nationalist upsurge in the valley in recent months. Some 30 people have died after security forces fired on protests here. Many say the relative calm at present is just the lull before another storm.

In the eye of the storm is the demand for azadi (freedom) for people living in the valley; the latest bout of unrest has brought the contentious issue back into the limelight again.

For many Indians the demand strikes at the heart of the ‘idea of India’, of a nation that is capable of handling diversity and staying united.

But for many of the majority Muslims living in the valley, freedom is the only way to get their pride back. It is the only way, they say, India can redeem itself in the hearts and minds of the Kashmiri.

No wonder, the streets in the valley were agog with cries for freedom during the huge protest processions that the recent crisis triggered off.

People have waved Pakistani flags and belted out pro-Pakistani slogans although, as Booker-prize winning writer Arundhati Roy says, it “would be a mistake to assume that the public expression of affection for Pakistan automatically translates into a desire to accede to Pakistan”.

This time, the call for Kashmiri freedom is coming from a generation of young and restless men and women who grew up during the troubled 1990’s when the valley was wracked by separatist insurgency.

On Kashmir streets, the yearning for freedom is a state of mind.

In a middle-class neighbourhood in Budgam where two young men were killed by security forces during recent protests, Sheikh Suhail, a 24-year-old mass communications student, makes no bones about it.

“We want azadi,” he says, days after he buried a friend who was shot down in the protest.

“Nobody quite knows what it will mean for us. We don’t know whether we will survive it. I only know that we want freedom from both India and Pakistan,” he says.

Across town, in the bustling Dalgate area, Sayed Zubair, a government school teacher, is seething after the security forces shot down his elderly neighbour during a recent curfew.

“We live in fear. A free Kashmir is the only solution to make us feel safe,” he says.

His neighbour, Hilal Ahmed, a bank manager, says freedom can help Kashmiris get rid of a twin “stigma”.

“India says it is the biggest democracy in the world. Living in Kashmir, we do not get any sense of that. Being a Kashmiri is a curse, being a Muslim is a crime. So we are doubly disadvantaged in these troubled times.

“The only way to set things right is to India get out of our lives and leave us free.”

So what does freedom mean for most Kashmiris?

Does it mean a sovereign state? Or does it mean greater autonomy? Many people here say that they prefer a form of self-rule. Does freedom from India mean accession with Pakistan? Or does freedom mean India pulling out its half a million or so troops in the state?

Eroded autonomy

For people like Suhail freedom is an intense sentiment. It is, they say, a breaking off from the “oppressive shackles” of the Indian state. For others like political scientist Dr Noor Ahmad Baba and women’s activist Dr Hameeda Nayeem, it is something more substantial.

Many analysts say that the autonomy that Kashmir enjoys under the Indian constitution has been eroded considerably and it is time that the Indian government worked out a new deal for its people.

Dr Noor Ahmed Baba says that when most Kashmiris say they want freedom, they do not necessarily mean seceding from India.

“The overwhelming people here want independence. But it does not mean a sovereign state. It could be a higher degree of autonomy rooted in a larger understanding with India and Pakistan, both of whom who would pledge not to interfere.

“For us freedom also means more choices about reviving our old trade, cultural and economic roots. We want to come out of seclusion,” he says.

Dr Hameeda Nayeem says Kashmiris want self-governance and great internal sovereignty – that is what freedom could essentially mean.

“Let us define self-governance. Whether it will be more autonomy or self-rule. Our borders could be jointly managed by India and Pakistan. We want soft borders and free flow of goods.”

She points to the example of the tiny kingdom of Bhutan and wonders why Kashmir cannot have the status of a “protected state” of India like Bhutan.

How could a beautiful valley – with an approximate area 15,520 sq km, only a sixth of the size of Bhutan – cope as an independent country?

‘Not realistic’

Omar Abdullah, head of the mainstream National Conference party, admits that that “freedom sentiment” is serious, but has grave doubts about its feasibility.

“How realistic is it? Will Kashmir ever be really free even if it becomes independent, surrounded as it is by India, China and Pakistan?” he wonders.

“How free can it be? What happens to Pakistan-administered Kashmir?

“Freedom is not an option. I have yet to see a model of freedom which convinces me that Jammu and Kashmir as a viable independent entity”.

The irony is that nothing that is being debated in the valley is new.

The builder of modern India and its first prime minister, Jawaharlal Nehru, spoke about a plebiscite in Kashmir and independence for the state with its defence guaranteed by both India and Pakistan.

And Mr Nehru’s letter to the maharajah of Kashmir four months after India’s independence in 1947 was also chillingly prescient.

“It is of the most vital importance that Kashmir should remain with the Indian Union,” he wrote.

“But, however much we may want this, it cannot be done except through the goodwill of the mass of the population.

“Even if military forces held Kashmir for a while a later consequence may be a strong reaction against this.

“Essentially, therefore, this is a problem of psychological approach to the mass of the people and of making them feel they will be benefited by being in the Indian Union.

“If the average Muslim feels that he has no safe and secure place in the Union, then obviously he will look elsewhere. Our basic policy must keep this in view, or else we fail.”
