Repealing AFSPA—need of the hour

“The UN Special Rapporteur on extrajudicial, summary or arbitrary executions took a serious exception to concerns about unlawful killings, both in terms of prevention and accountability. His emphasis was on the use of force by state actors like the police and the armed forces.”

Christof Heyns, United Nations Special Rapporteur on extrajudicial, summary or arbitrary executions, conducted a 12 days’ fact finding mission into Indian Occupied Kashmir. At the end of his tour, the UN Human Rights organization issued a formal Press Statement highlighting the concerns of the high level UN visit. Whereas, Christof Heyns took cognizance of India being a robust democracy, he also expressed serious concerns, stating that at the same time India faces many challenges to the realization of human rights, including movements aimed at separation or greater local autonomy, Maoist or Naxalite, insurgency, organized crime, and communal organizations opposed to secularism, plurality and equality.

The UN Special Rapporteur on extrajudicial, summary or arbitrary executions took a serious exception to concerns about unlawful killings, both in terms of prevention and accountability. His emphasis was on the use of force by state actors like the police and the armed forces. He highlighted the disproportionate use of force during demonstrations, which resulted in over 100 deaths, in 2010 in Jammu and Kashmir. His major concern was that demonstrations in New Delhi and other states were never treated harshly while unbridled force was unleashed on demonstrators in Indian Occupied Kashmir.

This spring the US drone killing program has come out of the closet. Attorney General Eric Holder publicly defended the drone killing of an American citizen [2], while Obama’s counter terrorism czar John Brennan publicly explained and justified the target killing program [3]. And a New York Times article by Jo Becker and Scott Shane chronicled Obama’s personal role in vetting a secret “Kill List.” [4]

This striking new transparency, the official acknowledgment for the first time of a broad-based US assassination and targeted killing program, has resulted from the unprecedented and controversial visibility of drone warfare. Drones now make news every day, and those of us who have been protesting their use for years have heightened their visibility in the public eye, forcing official acknowledgment and fostering worldwide scrutiny.  This new scrutiny focuses not only on drone use but also, and perhaps more importantly, on the targeted killing itself – and the “kill lists” that make them possible.

(AP) — Pakistan called Friday for President Barack Obama to intervene in its long-standing dispute with India over the Himalayan region of Kashmir, the cause of two of the three wars the nuclear-armed rivals have fought.

Pakistani Foreign Minister Shah Mahmood Qureshi made the unusually blunt appeal for Obama to seek a resolution of the dispute when he visits India next month, saying he should “redeem the pledge” he made as a candidate.

The conflict over Kashmir has been the main source of friction between India and Pakistan since they won independence from Britain in 1947. Pakistan has frequently sought outside intervention to resolve it but India vehemently opposes such involvement and the United States has traditionally stayed above the fray.

Qureshi expressed astonishment that the U.S. and other major powers had said little about India’s response to the protests.

“People of conscience have protested the use of force against the defenseless people of Kashmir, in particular the targeting of the Kashmiri youth,” he said. “But the Kashmiri mothers are baffled by the deafening silence of the world’s leadership. History has proved that the force of arms cannot suppress the legitimate aspirations of the Kashmiri people.”

India and Pakistan fought two wars for control of Muslim-majority Kashmir, where rebels have sought independence from India or incorporation with neighboring Pakistan.
More than 68,000 people, most of them civilians, have been killed in Kashmir since fighting began in earnest in 1989.

Indian government forces say they have evacuated hundreds of people after a fierce gunbattle erupted with three suspected Muslim rebels hiding in a village in the Indian portion of Kashmir.

Lt. Col. J.S. Brar, an Indian army spokesman, says soldiers and police cordoned a portion of Maloora, a village on the outskirts of the region’s main city Srinagar, following intelligence that suspected rebels were hiding there.

Brar said Thursday heavy gunfire between the suspected rebels and government forces is continuing.

Why India gets away in Kashmir

Kashmiris resent, quite rightly, the intrusive presence of India’s jawans on their streets. But the jawans don’t want to be there. New Delhi doesn’t want the jawans there either. So why are they there? India says the army is in Kashmir because of terrorists, who can only be handled militarily. This is only partially true. The reason the army is deployed in Srinagar city is to block its citizens from coming out on the streets and demanding azadi, as they did in the early 90s.

If Kashmiris would elect their leaders and not demand azadi, the army would go away. This is what the Indian government wants, and is desperate to do, but too embarrassed to say. This is not debated in India’s media either because, since Pakistan is involved, we have fed ourselves myths about how the problem in Kashmir is the creation not of India but Pakistan.

The Identity of Kashmir in Contemporary History

Introductory Note: About a decade back, the Centre for European Studies, Jadavpur University, organized an international seminar around identity politics. Dr. Nandinee Bhattacharya (Calcutta Girls College) and I presented a paper entitled Imagined Authenticities: National and Supranational Identity Building in Kashmir and Tadzhikistan. Subsequently much time has lapsed. The present essay is based on the portion on Kashmir, for which I was mainly responsible. As I could not get Dr. Bhattacharya’s permission before publishing this in a slightly different form in a printed journal, I have been forced to omit her name. But I wish to record that the arguments developed here have her inputs too.

 

Kashmir and Central Asia:

There is a long stretch, from Kashmir via Afghanistan to the ex-Soviet Central Asia, where ethnic, linguistic, religious and other identities jostle uneasily. Plural identities might not have caused any harm, were it not for the fact that each identity is held up by its champions as the sole authentic identity. In this essay, my concern is to argue that imagined histories of authenticity do not provide convincing cases for contemporary forms of unity. Instead, they often result in destructive conflicts. One could mention Afghanistan and Tadzhikistan as other such cases. Space constraint and the need to present a focused narrative prevent me from doing so at any length. But a few points will bring out one highlight, which I would like to return to at the end of the essay.  Tadzhikistan and Kashmir have certain similarities. Both have been parts of multi-national, multi-ethnic states. Both have, in the past, had tolerant religious traditions. But there have also been important differences. The point I wish to make is not that these are identical, but that historical patterns cannot be unquestioningly called into the service of any force. Texts of contemporary or modern history, documents, agreements and violations of agreements, and so forth, might be of more use in working out legalities. But the building of modern nations and states in a democratic manner, where citizens can really control their lives, and not simply take part in make believe electoral farces, calls for a sharp questioning of all prevailing claims of authenticity that can impose totalitarianism in the guise of democracy coupled with “national security”.

At the Precipice of War: U.S. Military Build-Up Accelerates in the Persian Gulf

July 17, 2012 “Information Clearing House” —  The familiar menace of U.S. war drums have resumed at a fevered pitch, as Iran finds itself once again firmly within the Pentagon’s cross hairs.

According to multiple reports, the U.S. is currently in the midst of a massive military build-up in the Persian Gulf on a scale not seen in the region since prior to the 2003 U.S. invasion of Iraq.  The military surge reportedly includes an influx of air and naval forces, ground troops, and even sea drones.  Lest one forgets, the U.S. already has two aircraft carriers and their accompanying striker groups in the region.

A growing sense of Iran war fever can also be seen mounting in Washington.  For instance, in an effort to foil ongoing nuclear negotiations between Iran and the so-called P5+1 (the five permanent members of the U.N. Security Council plus Germany), a bipartisan group of 44 U.S. Senators recently sent a letter to President Obama urging the administration to “focus on significantly increasing the pressure on the Iranian government through sanctions and making clear that a credible military option exists.”

It’s one thing to support killing militants, and quite another to empower one man to do it in secret without checks or meaningful oversight.

Essayist Tom Junod’s latest masterpiece, “The Lethal Presidency of Barack Obama,” grapples at length with the unprecedented assassination program that the United States has waged since 2009. “Your lethality is expansive in both practice and principle; you are fighting terrorism with a policy of preemptive execution, and claiming not just the legal right to do so but the legal right to do so in secret,” the piece, addressed to the president himself, states. “The American people, for the most part, have no idea who has been killed, and why; the American people — and for that matter, most of their representatives in Congress — have no idea what crimes those killed in their name are supposed to have committed, and have been told that they are not entitled to know.”

Notice the multiple objections that the essay sets forth. It expresses unease with the mere fact of so much killing. But it concerns itself as much with process. The Obama Administration isn’t just assassinating an unprecedented number of individuals. It is doing so in a secret, unaccountable manner that lacks transparency or a meaningful check on the power of the executive.

President Obama’s defenders conveniently ignore all but one of these objections.
